Predictive Writing & the Discussion Section

This week builds on the memo architecture from Week 12 and focuses specifically on writing effective Discussion sections — the analytical heart of the legal memorandum. You will practice writing rule explanations using case illustrations, crafting analogical reasoning in the Application section, organizing multi-issue analyses, and maintaining the objective predictive voice throughout.

Key Rules

Rule explanation should progress from general principle → specific elements → case illustrations showing application. Don't just state rules — explain how they work.
Case illustrations are mini-briefs embedded in the rule section: show the key facts, the court's reasoning, and the result to demonstrate HOW the rule operates in practice.
Analogical reasoning connects rule to facts by comparing: 'Like the plaintiff in [Case], who [facts], here our client [similar/different facts], suggesting the court will [predicted outcome].'
Counter-analysis is required for objectivity: 'However, defendant may argue [counterargument]. This argument is [likely/unlikely] to prevail because [reasoning].'
Each IRAC section should have a topic sentence that previews the conclusion, followed by the analysis that supports it.
Transitions between sections should show the analytical connection: 'Having established that a duty existed, the analysis turns to whether defendant breached that duty.'

The Discussion is where you demonstrate legal reasoning. It follows IRAC but with sophisticated development:

Case Illustrations

A case illustration is a compact example embedded in the Rule section:

In Smith v. Jones, the court found the plaintiff's silence constituted acceptance where the parties had a five-year course of dealing in which silence always indicated agreement, and the plaintiff retained and used the delivered goods for three months without objection. 145 Cal. App. 4th 200, 205 (2019).

Purpose:

- Shows HOW courts apply the rule - Provides a factual comparison point for Application - Makes abstract rules concrete

Analogical Reasoning

The Application section's core technique:

1. Identify key facts from precedent case 2. Compare to client's facts 3. Draw inference about predicted outcome

Template:

Like the defendant in [Case], who [key facts leading to outcome], here [client] [similar facts]. Because the court in [Case] found [outcome] under those circumstances, a court here will likely reach the same result because [connection].
